died on friday night. boston seven days after the attack. but we begin with chief washington correspondent james rosen and stunning news of another planned attack of terror. good evening, james. >> bret, good evening. canadian officials announced today they arrested two men this afternoon and charged them with plotting with the aid of al qaeda to blow up a passenger train traveling from new york to the greater torrent area. the alleged terrorist are age 30 and are raheed of toronto. they worked with canadian intelligence and u.s. national security and law enforcement officers to interrupt this alleged plot in an 8 month investigation code named project smooth. they said the plot was detected early on and neither american nor canadian citizens faced any imminent threat as a result. u.s. officials told fox news the defendants' objective was to blow up a bridge in the tore torrent area tornted while the

herridge is here tonight with an update on that. good evening, catherine. >> thank you, bret. some of the most compelling evidence and preliminary evidence comes from surveillance video and one eyewitness during that carjacking thursday night before a shootout with police one of the brothers said, quote: did you hear about the boston explosion? i did that. court records filed monday show the tsarnaev brothers walked into boylston street together 11 minutes before the explosions, each with a backpack. they split up. one heading for the finish line and the other toward the forum restaurant, the site of the second explosion. 30 seconds before the first blast. the started fidgeting with cell phone after the blast almost everyone turned around, quote: apparent bewilderment and alarm while the 19-year-old suggested calm. as the court records were unsealed the white house defended the fbi's investigation of tamerlan tsarnaev 2011 two years before the boston bombings,

the 26-year-old was a follower of radical islam. >> we have a process in this country where we have to find grounds for action and fbi did an investigation and did not find grounds for action at the time. >> fox news is told that investigators are now doing, quote: a deep dive on tamerlan tsarnaev's six month three-point russia last year and whether the 26-year-old had direct contact with known or directed terrorists in the region. the investigators continue to probe possible link islamist and extremist groups. >> we chechen terrorists related to the elm rit, iraq, pakistan and afghanistan as well as elsewhere. 2007, the head of the caucus elm rit actually directly threatened the united states of america. >> the fbi unaware the older brother's trip in 2012 because he apparently traveled under alias or the airline made error on spelling. based on briefing with the assistant director of the fbi leading republican senator suspects the

brothers had outside help. >> the fbi and the cia. scrambling to figure out what's coming next. >> fox news is told that in late 2011 the fbi informed the russians on at least two occasions the bureau had not found any derogatory information on the older brother and requested additional information but the bureau says there was no immediate response from the russians, bret. >> bret: okay, catherine, thank you. following all angles here. dzhokhar tsarnaev has been charged with a federal crime and will go through the criminal court system. jennifer griffin reports some people obviously are not satisfied. good evening, jennifer. >> good evening, bret. jay carney ruled out the alleged marathon bomber would be designated enemy combatant even though lindsey graham and others say the designation would have allowed authorities to mine intelligence for 30 days and question the suspect about possible links to terrorist groups actively trying to harm the united states.

>> the ability to have access to this suspect without a lawyer present, to gather intelligence about a future attack is absolutely essential to our national security. >> critics say the president can't do that because tsarnaev doesn't fit the legal definition of enemy combatant. there is no proof yet that he is an active member of al qaeda or the taliban. >> possibly you might be able to benefit from the time. you may not. he may clam up. it's just as likely if not more likely that you would harm or potentially harm the federal case. >> the white house decision sets a pattern, since march 2009 the obama administration changed the way the war is prosecuted. ordering the pentagon who stop using the term global war on terror. instead calling it an overseas contingency operation. the president's current cia director raised eyebrows when he declared jihad is not necessary lay bad thing.

investigators say they have found no trace of ricin in the house of the man suspected of sending letters containing the poison to the white house and capitol hill. an fbi agent testified today at a hearing for paul kevin curtis that investigators have also failed to find evidence the suspect used his computer to research a recipe for ricin. curtis denies any involvement. what do you get when you put bill and hillary clinton's names on an airport? the answers later in the grapevine. and up next, making the flying public feel the pain of the sequester. ♪

to put the traveling public in. >> the faa says it's 15,000 air traffic controller have to take off one day every two weeks without pay. this result of the automatic spending cuts congress passed in 2011. the airline industry says the faa's plan maximizes flight delays. >> we believe that the faa has the discretion not to furlough the air traffic controllers. they keep the planes in the air, get them to the ground and keep travelers moving, keep shipping moving and that's critical to our economy. >> congressional republicans charge the administration is structuring these cuts to worsen their impact. in a statement, congressman bill shuster the chairman of the house committee on transportation and freezing rain structure says quote the administration views the sequester as an attempt to score political points rather than address real issues and find real savings in a bloated federal bureaucracy. he points to sizeable increases in the faa's budget and continued spending on consultants and travel. the administration says the law requiring these cuts gives officials few options.

>> furloughs cannot be avoided. 70% of the faa's operation's budget is personnel. the faa must furlough 47,000 employees up to 11 days between now and the end of the fiscal year. >> the replace cuts with other cuts and tax increases on the wealthy. >> this fight is playing out in court as well. the nation's airline association is suing the f.a.a. to halt these furloughs claiming that the administration has the authority to cut elsewhere. bret? >> bret: rich edson at washington's international airport. rich, thanks. wall street is trying to recover from its worst week of the year. the dow gained 20. the s&p 500 was up 7. the nasdaq finished up 27.50. >> we're not so sure about obama phone, however. whether he likes it or not, and even though he didn't create it, chief news

correspondent the president is linked to another popular give away program. >> what started out as an effort ronald reagan help people in poor areas have a phone in rural areas has mush roomed in what rit particulars suspect is a new welfare program. >> the cost has gone from $143 million a few years ago to $2.2 billion today. a 15 times increase. >> the cost of the program left after cell phones were added in 2008. only low income people on welfare legally qualify but lawmakers say the program is out of control. >> i got a solicitation for a free phone at my apartment which is certainly not in a building where you are going to have people who are qualified for free phones. there is clearly money being wasted here. >> the fcc itself said in a recent year there were 270,000 beneficiaries that have more than one of these subsidized cell phones. that's completely against the law right there. >> funded by a small tax on all phone bills, the

the boston bombings have reframed the immigration reform discussion a little bit in washington. mike emanuel shows us what happened today when partisan politics crentd back in. >> let no one be so cruel as to try to use a heinous acts of these two young men last week to derail the dreams and future of millions of hard-working people. >> the chairman of the senate judiciary committee set the tone in an immigration reform hearing one week after the boston attack. a situation became more heated when the top republican on the committee chuck grassley clashed with gang of eight democrat chuck schumer. >> i say that particularly those who were pointing to what happened, the terrible tragedy in boston as a -- i would say excuse for not doing a bill or delaying it many months or years. >> iner said that! i never said that. [gavel. >> i didn't say you did, sir. >> marco rubio said boston should have a bearing on the debate, quote. if there are flaws in our immigration system that in boston.ed by the

any immigration reform passed by congress this year should address those flaws. meanwhile, in a letter sent today to senate majority leader harry reid, kentucky republican rand paul wrote: quote, we should not proceed until we understand the specific failures of our immigration system. in an interview with fox, speaker john boehner said he didn't see a need to delay this reform effort. >> i'm in the camp of if we fix our immigration system it may actually help us understand who all is here, why they are here, and what legal status they have. >> and texas republican senator ted cruz suggested the surest way to pass something was to narrow the focus. >> i think there is bipartisanship agreement that we have got to get serious about securing the border. i think there is likewise wide bipartisan agreement that we need to improve legal immigration. >> cruze is hoping to strip out the cap for citizenship for the estimated 11 million illegals already

here. meanwhile jay carney suggested reform effort should continue because improvements would help security. bret? >> bret: mike emanuel live on the hill. thank you. denver police say they have learned the identity of a suspect seen leaving a shooting at a pro-marijuana rally saturday. two people were wounded in that shooting as you can see all the people running out of there. police say they have video of the shooter and his accomplice who walks away after the shots were fired. the defense in the trial of a philadelphia abortion doctor did not begin its case as scheduled today. the defense attorney game ill and went to the hospital. attorney jack mcmahon apparently was suffering from pneumonia last week. dr. kermit gosnell is accused of murdering one woman and seven babies born alive. he says he is not guilty. we will continue to follow the case. terror charges in boston and a new plot in canada. we'll talk about all of it with the special edition of fox all-stars when we return. ♪

>> he will not be treated as an enemy combatant. we will prosecute this terrorist through our civilian system of justice. >> there is ample evidence here on the criminal side, a first year law student could prosecute this case. what i'm worried about is what does this individual know about future attacks or terrorist organizations that may be in our midst? we have the right to gather intelligence. under the criminal system, you should not question someone without their lawyer present. under the law of armed conflict, when you are trying to gather intelligence about future attacks against your nation, there is no requirement for a lawyer. it would disturb me greatly if this administration is relying exclusively on the criminal justice system to gather intelligence. >> bret: this afternoon, the suspect in the boston marathon bombings was

charged. federal charges, dok dzhokhar tsarnaev met with a magistrate in hospital room are you able to answer questions? defendant nods affirmatively. the transcript continues on and all that we're seeing is defendant nods affirmatively but he was read his miranda rights through throughout the proceeding. bring in expanded panel tonight brit hume, juan williams columnist with the hill, julie paste, white house correspondent for the associated press and jonah goldberg at large editor for the national review online. let's start here, brit: >> lindsey graham, i think what jay carney said is correct you couldn't -- as an american citizen he could not be tried before a military commission. but lindsey graham may well have a point but how he should be treated whether initially as enemy combatant. you don't have to try somebody in a military

commission other way around. he could be questioned as an enemy combatant and subsequently turned over for prosecution. that's the way they could do it. as enemy combatant he could be questioned without a lawyer present. it appears that that opportunity is gone. that he has already been read the charges, confirmed them. lawyer present. miranda rights read. so he may well cooperate and this may well all have a happy ending and i hope it does and i hope everything works out just fine. there is at least a chance that some information will be lost because of this and it seems to me that when you have an attack of this kind related to muslim extremism as this plainly is especially in the case of the older brother perhaps in the case of this young man as well that intelligence is critical and ought to be a priority. >> bret: yuan, we don't know what if anything he has told investigators up until he was read his miranda rights. that's what we don't know. he is clearly not speaking because of the injury. but, your thoughts? >> i was going to make the

point that you made, which is that we don't know what he said before he was read his miranda rights. and it would indicate from the fact that he is nodding that maybe he wasn't able to speak. maybe, i don't know but that's my assumption based on the transcript. i will say i don't think the president had any choice. i think the law is very clear on this. he is an american citizen captured on american soil. if you were to look at james holmes or timothy mcveigh, you would have to say well, how would you make a distinction between these two? these are americans on american soil who committed even more horrific acts in terms of the number of debts -- depths that occurred as a result of their terrorist activity. you would have to make assumptions about the link to chechnya and muslim radical islam and all the rest. as a matter of law, i think he had they had the public safety exemption under miranda that could have allowed them 48 hours or movement more. i'm hoping they made informed decision about what they did here. >> i think this have really

in keeping with what we have seen from the administration the past four years. they really believe that the criminal justice system, not only is the right approach but also is effective and there is some evidence to back that up. the criminal justice system does have a strong record in convicting terrorism. and military tribunals you don't have that option. also an interest on the part of the white house to have this be a speedy process and they feel like in taking these steps this is more orderly and they can move this process along quick. >> bret: there are examples where american citizens, enemy combatants they still go to federal court. lindsey graham actually wrote the law. i mean, he wrote the act and they don't go to military commissions. i think we are talking apples and oranges here. >> we have a lot of confusion here. this is where i disagree with juan. cases going back to the civil war. the president has the authority to declare somebody an enemy combatant. all that means when you talk to them. anything they tell you in

the context of intelligence gathering cannot be used against them in a court of flaw a criminal proceeding. that's what the constitution says is that you have a right not to be compelled to incriminate yourself in a criminal proceeding. intelligence gathering thing there are all sorts of ways where you wall off what you get from his intelligence gathering. not poison a criminal case and every lawyer that has looked at this has said they don't need a confession from this guy. they have so much evidence that the idea that somehow if he tells them something he might get off no one thinks that's a possibility. i think, you know, jane harman on here on sunday was sort of indicative on this is that there is a lot of confusion between military tribunals and enemy combatants. can you be enemy combatant and not have anything to do with a military tribunal. >> what's worrisome here is that the administration's approach to this and its insistence and we have seen this repeatedly that the criminal justice system is the way to go is rooted, in my view, not so much that this is the most effective way to try them and certainly not rooted in the

idea that this is the most effective way to gain intelligence. it's rooted in an international public relations idea that we must remain true to what is considered our values. the president has said as much that this is why we must do this. and it seems that the appearance of things, to the world is what the administration is worried about. as if by virtue of the fact that we try people in our civilian courts instead of elsewhere or don't call them enemy combatants we will somehow gain favor with those who would seek to kill us. i think it's funsful. >> i think it's clear it's not the case. it seems to me we have the patriot act. changed our civil liberties protecting ourselves willing to go after people who are suspects and look into their emails, their phone calls, their travel. i don't think there is any evidence. >> juan, this is a case here and not the first one where the fbi was tipped off by a foreign government. look, i know that happens from time to time. but i doubt it happens every day. and they went and looked at this guy and somehow failed to figure out that he was a

potential serious terrorist. this happened in major hasan case. he is still awaiting trial. but, they are not even at the pentagon classifying that as terrorism. that's still work place violence. the worry that i have is that the fbi and other investigative agencies concerned about appearances and concerned about the possibility we will be seen as having anti-muslim bias are treading softly in the case of some of these people who have turned out to be terrorists. >> one quick point is that they should be concerned about the law and the fact that you and i are americans. we don't want to give them unquestioned, unchecked power to say oh, we're going to treat this guy as a terrorist and not that guy. that's not constitutional. we all have fifth amendment rights. >> bret: they do have a right to challenge the designation of enemy combatant in court. and they would have a chance to go before a judge and make their case. >> that's what i say. >> what's your beef against calling him enemy combatant? >> i want to get to this other case because there are other people who want to kill americans. and one of -- it appears

plot but said the public was not in danger. back with the panel. julie? >> well, in some ways this is how the system was supposed to work. there was a plot. authorities found the plot and they thwarted it they have these men in custody. i think it's important to note that obviously this comes at a time when a lot of people are on edge, given the events of last week, the justice department has told us that there stunt appear to be any connection between what we have understood have been happening in canada and the boston plot. but, obviously in general, this raises the speck temperature of terrorism. and that -- peck tore of peck tore of terrorism. >> it is sort of how celebrities die in threes. strange how we have two terror plots next to each other along with the ricin one sipping on 9/11. am thrax attacks and terrorist attacks had nothing to do with each other but came at the same time. iran part, at least the old fashioned bush doctrine said if you are a state that toler rates terrorists on your own soil then you

are sponsoring terrorism. were. >> harboring. >> harboring them. that's why we went to war with al qaeda in afghanistan. brit? >> it will be interesting to see what the president admie to say about. this in terms of our policy towards iran. we say from time to time this is a state sponsor of terrorism. now comes a plot hatched, apparently in iran. so what is the president's attitude toward this going to be? we try to stop them from getting weapons of mass destruction. it appear interests that country terrorism is being exported. whether by the inspiration or direction of the government apparently we don't know. but there it is. that's where it's coming from. a lot of people suspected this for a long time about iran. now we have the iran-al qaeda connection laid out for us in the prosecuting documents from the mounties. >> bret: juan, we don't know about the ties on the boston case obviously with

islamic extremism. we know it was on their web sites. we know what they were espousing but we don't note specific ties as they look into tamerlan's travel overseas. the older brother. but, these canadian officials are saying it's clear tied to al qaeda. what about the whole tie of al qaeda is diminishing. the threat is is diminishing. we have got them on the run. are we starting to see a different thing develop that perhaps is much different than what we heard from the administration? >> no. i think that there is a new type of al qaeda connection. there is something that we have to understand that has evolved or in some sense mutated. which is it is not a hierarch call order, training and these people were sent to commit this act. >> bret: which indicates order and giving direction? >> that's what i'm saying. i think in general the

bigger threat at the moment is not because i think the administration of the united states has disseminated al qaeda as we knew them on 9/11. the bigger threat now is is that you get groups that are splinter groups or people that are online and leading these radical islamic and al qaeda magazines about how to commit terror how to build pressure cooker bombs and these people then, acting as so-called lone wolves or in groups of two like we suspect with these people in boston commit a terrorist act. now, you say is that al qaeda linked? now it's kind of a -- yes, they are following al qaeda's inspiration. but it is different than saying that they are al qaeda. >> bret: i think there are a lot more connections that we would like to know about with al qaeda and the splinter groups. perhaps from those documents we have yet to see from the bin laden compound. >> i think this is one of those situations that it's tricky for the administration as they try to message it on the one hand they do have a political interest in saying that al qaeda has
